§ 2 Right of withdrawal and return instruction

Withdrawal

You can cancel your contract within two weeks without giving any reasons (e.g. by letter, fax, e-mail) if you receive the goods before the deadline by returning the goods. The deadline begins upon receipt of the written notification. In order to safeguard the withdrawal period it is sufficient to send the revocation or thing in time. The revocation is to address to:

Consequences of Withdrawal

In the case of an effective cancellation the received benefits have to be returned (from both parties) – non-returnable profits will be invoiced. In addition, you can avoid any costs of misuse by using the goods in a way that will not affect the value of the product. You have to pay the transport costs if the value is less than 40 € and you can not claim any damages.

Return

You can use the goods without stating any reasons within two weeks. The time limit begins after receipt of this instruction in writing (eg letter, fax, e-mail), but not before receipt of the goods. Only in the case of goods not shipped by parcel (eg bulky goods) you can explain the return also by cancelling in text form. Consequences of Return

In the case of an actual return, the mutually received benefits are returned and any benefits (e.g. advantages) issued. With respect to damages of the goods, compensation will be required. This does not apply if the deterioration of the product is exclusively caused due to their examination - as it would have been possible in a shop. In addition, you can avoid to pay compensation if the customer uses the product with caution and does not reduce the value of the product. Obligations to reimburse payments must be made within 30 days. The time limit begins for you with the dispatch of the goods.

§ 3 Prices

§ 4 Conclusion

Delivery

If the ordered products are available, they are delivered immediately after receipt of payment. Since most products are specially made, the delivery can be delayed. Therefore, you should ask for delivery times in advance.

Returns

Shipping costs are 4.90€ within Germany, depending on the total weight of the ordered goods. For shipments to other EU countries and Switzerland shipping costs are calculated by 6.90€.

§ 6 Payment Terms

"Fa Bismillah C. Sungur" provides the customer with an invoice for the goods ordered. "Fa Bismillah C. Sungur" supplies against advance payment or PayPal. Prices on the bill are always retail prices including VAT.

§ 7 Guaranty

The customer needs to inform “FA. Bismillah C. Sungur” about deficiencies related to the product, and in addition has to send back the product at the expense of "Fa Bismillah C. Sungur". The seller's warranty is governed by § § 433 ff BGB. In entrepreneurial business the warranty is limited to one year and "Fa C. Sungur Bismillah "is entitled to provide the customer with free repair or replacement of the product. The time for repairing may vary and can take up to 14 days. The right of replacement / repair is not extended to any damages caused by the buyer (damage caused by natural wear and tear improper handling, temperature or weather conditions, or failure to observe the operating instructions).

§ 8 Force Majeure

In the event of forced majeure (especially war, natural disasters) "Fa Bismillah C. Sungur" does not need to fulfil its services. Is "Fa Bismillah C. Sungur" not able to deliver for more than 1 month - due to forced majeure - the customer is allowed to cancel the contract.

§ 9 Jurisdiction

Consumers

If a party is not resident or located in the Federal Republic of Germany, the place of the seller is not the general jurisdiction. Only jurisdictions, for example for the judicial enforcement of debts, remain unaffected.

Commercial Customers

Jurisdiction is the domicile of the seller.

§ 10 Final Provisions

Contract language is German.
If any provision of these Conditions be or become invalid, the rest of the Conditions remain valid. The invalid provision will be replaced by a valid one which is acceptable for both parties.

§ 11 Severability

If any provision of this agreement is invalid or unenforceable the contract will remain valid and is. The foregoing provisions apply mutatis mutandis to the case that the agreement turns out to be incomplete.Übersetzen...
